Important Deadlines for UAE Corporate Tax Registration: Decision No. 3 of 2024

Are you a corporate entity operating in the UAE? Then mark your calendar, because the UAE Federal Tax Authority has laid down some crucial deadlines regarding corporate tax registration in Decision No. 3 of 2024, issued on 27 February 2024.

First and foremost, let’s address the general deadline for submitting your application. If your corporate entity was established before 1 March 2024, the clock is ticking, and your application must be submitted by 31 May 2024. However, for those entities incorporated after this date, including branches of foreign entities, different timelines apply.

For Resident Persons:

  • If your corporate entity was established before 1 March 2024, your deadline depends on the issuance date of your license. For instance, if your license was issued in January or February, you have until 31 May 2024 to submit your tax registration application. The deadline gradually extends until 31 December 2024 for entities with licenses issued in December.
  • In the event that your entity lacks a license as of 1 March 2024, you have until 31 May 2024 to submit your application.

For entities established on or after 1 March 2024:

  • If you fall under the category of juridical persons incorporated in the UAE or recognized under its legislation, including Free Zone Persons, you must submit your application within 3 months from the date of incorporation, establishment, or recognition.
  • Meanwhile, for those recognized under foreign jurisdiction but effectively managed and controlled within the UAE, the deadline is set 3 months after the end of the financial year.

As for Non-Resident Persons:

  • Branches of foreign entities are subject to different deadlines based on whether they were within the scope of corporate tax before or after 1 March 2024. If within the scope prior to this date, the deadline is 9 months from the branch’s inception. Of note, if falling under the scope on or after 1 March 2024, the deadline is 6 months from inception.

More importantly, it’s worth noting that the timelines for branch registration seem contingent upon the commencement of the branch’s first tax period.

IMPORTANT: Remember, failing to meet these deadlines incurs a penalty of AED 10,000.
